Recruitment Advertisment

The Sex Discrimination Ordinance, Disability Discrimination Ordinance and Family Status Discrimination Ordinance have been in effect. Except where the legislation provides exemption for liability, recruitment advertisements should not include the following as their recruitment criteria:

  • Sex
  • Martial Status
  • Pregnancy Status
  • Disability Status
  • Family Status

What happens if the Code is not complied with?

  • The EOC may apply to the District Court for the imposition of a financial penalty on a person who has published or caused to be published a discriminatory advertisement. The penalty shall not exceed $10,000 for the first occasion on which a penalty is imposed, and shall not exceed $30,000 for the second or subsequent occasion on which a penalty is imposed.
