In House Lawyers are employed by organisations to provide legal advice, draft and review contracts, manage disputes, and ensure that all the company's transactions comply with the law. These legal experts work within a specific organisation rather than being part of a legal firm that works with multiple clients. An In House Lawyer's duties can extend across areas such as employment law, privacy, intellectual property, commercial and corporate law. Although they generally work office hours, they may need to work longer when dealing with significant legal issues or projects.
Tasks and duties
- Developing and advising on company policies and ensuring they align with the law.
- Drafting, vetting and negotiating contracts for different business activities.
- Representing the company in any legal proceedings or disputes.
- Advising and supporting human resources on employment law related issues.
- Keeping up-to-date with changes in law and advising management accordingly.
- Providing training to the company on legal matters, compliance and ethics.
How to become an In House Lawyer
In-house lawyers or legal counsels protect the organisation’s legal interests, assess risks, ensure compliance and craft company policies, among others. Most companies require that legal counsels be qualified lawyers with years of experience.
- An L.L.B. (Bachelor of Laws) or higher in legal-related discipline. Some organisations prefer a postgraduate law degree.
- Should have experience in practising law and offering legal advice. To qualify as a trainee solicitor, an individual must undergo two years of training in a Hong Kong law firm.
- Some organisations combine the counsel role with the corporate secretary role, which may require qualification to the HK Chartered Governance Institute.
- Competent in drafting and reviewing high-value legal documentation under time pressure.
